South African courts are reasonable when it comes to granting divorces but the law requires the reasons to fall within a few broad categories:
If the husband and wife have not lived together as husband and wife for at least a year. If you are still living together the courts may not be willing to grant the divorce even if the divorce is unopposed.
If one party has committed adultery and the other party believes this renders the marriage irreconcilable. It is also acceptable for the party applying for the divorce to be in an adulterous relationship as can prove the marriage has irreconcilably broken down.
If one party is currently in prison.
If one party has been committed to a mental institution for at least two years. This will also need at two psychiatrists to agree that there is not reasonable chance of a cure.
If one party is unconscious or has been in a coma for at least the last six months. This will need two doctors including a court appointed neurologist to agree that there is no reasonable chance of a cure.
